1. Acceptance of Terms
By accessing, browsing, or using www.healthpointind.com (the "Website," "Platform," or "Service") and related applications, you acknowledge and agree to be bound by these Terms and Conditions ("Terms"), our Privacy Policy, and all applicable laws and regulations. If you do not agree with any provision of these Terms, you must not use our Service.
By clicking "I Accept" or continuing to use the Service, you accept these Terms in their entirety.
2. Definitions and Clarifications
- "Health Point IND," "We," "Us," "Our": Refers to Health Point IND, a diagnostic booking and coordination platform owned by Mr. Sumit Jadhav, located in Pune, Maharashtra.
- "You," "Your," "User," "Patient": Any person who accesses, registers, or uses our Platform and services.
- "Partner Diagnostic Centers": Independent diagnostic facilities, imaging centers, and laboratories with which we partner to provide services (MRI, CT, Ultrasound, X-ray, Blood tests, etc.). These are NOT employees of Health Point IND.
- "Services": Booking coordination, appointment scheduling, information about diagnostic tests, pricing comparison, and communication between you and Partner Diagnostic Centers.
- "Medical Professional" or "Referring Physician": Licensed doctors or healthcare providers who issued a prescription or referral for diagnostic testing.
- "Diagnostic Test" or "Scan": Any diagnostic imaging (MRI, CT, PET CT, X-ray, Ultrasound, Mammography) or laboratory test (blood work, pathology) performed by Partner Diagnostic Centers.
3. Core Services and Role of Health Point IND
3.1 What We Do
Health Point IND provides a BOOKING AND COORDINATION PLATFORM ONLY. Our services include:
- Listing partner diagnostic centers, services, pricing, and availability
- Helping you search and compare diagnostic facilities
- Processing your appointment bookings and payments
- Sharing your appointment details with Partner Diagnostic Centers
- Sending appointment reminders and pre-test instructions
- Providing customer support for booking-related issues
- Using automation and AI tools to assist with booking coordination and notifications, while preserving the role of licensed healthcare providers in medical decisions
3.2 What We Do NOT Do
IMPORTANT—Health Point IND is NOT responsible for:
- Performing, conducting, or interpreting diagnostic tests or scans
- Providing medical advice, diagnosis, or treatment recommendations
- Employing, supervising, or controlling medical professionals at Partner Diagnostic Centers
- Guaranteeing accuracy, quality, or timeliness of reports from Partner Diagnostic Centers
- Providing imaging machines, medical equipment, or facilities
- Recommending specific tests or treatments (this is the role of your referring physician)
- Managing your medical records or health history
- Providing emergency medical care
- Handling patient complaints about diagnostic quality or clinical outcomes
Partner Diagnostic Centers are independent healthcare service providers and are solely responsible for the medical services they provide.
3.3 No Doctor-Patient Relationship
CRITICAL: Using Health Point IND does NOT create a doctor-patient relationship between you and Health Point IND. We are NOT healthcare providers. Any diagnostic tests are conducted by Partner Diagnostic Centers, and your relationship is with them, not with us. You must obtain medical advice from licensed physicians, not from our Platform.
4. User Registration and Eligibility
4.1 Age and Legal Capacity
- You must be at least 18 years old to register and use the Service
- If you are a minor (under 18), a parent or legal guardian must register and book on your behalf
- You must have the legal capacity to enter into binding agreements under Indian law
4.2 Accurate Information Requirement
- You agree to provide accurate, complete, and truthful information during registration and booking
- This includes full name, date of birth, contact information, medical history, and symptoms
- You are responsible for maintaining the confidentiality of your login credentials
- You agree to update information promptly if it changes
- Providing false or misleading information may result in account suspension or legal action
4.3 Account Responsibility
- You are responsible for all activities that occur under your account
- You must not share your login credentials with anyone
- You must notify us immediately if you suspect unauthorized access
- We are not responsible for any unauthorized use of your account if you fail to protect your password
5. Your Obligations and Responsibilities
5.1 Accuracy of Medical Information
- YOU are entirely responsible for the accuracy of medical information you provide (symptoms, medical history, allergies, contraindications, medications)
- Incomplete or false medical information may lead to incorrect test selection, machine incompatibility issues, or compromised safety
- You must disclose all relevant medical conditions, especially:
- Metal implants, pacemakers, metallic hardware (relevant for MRI)
- Allergies to contrast media or other medical substances
- Pregnancy or possibility of pregnancy
- Recent medical interventions or surgeries
- Medications you are currently taking
- Kidney disease or renal dysfunction (relevant for contrast studies)
- Health Point IND is NOT liable for adverse events caused by incomplete or inaccurate information provided by you
5.2 Why We May Request Prescriptions or Medical Documents
We may request one or more of the following documents:
- Prescriptions
- Referral letters
- Previous reports
- Clinical history
- Scan recommendations
These documents may be requested for:
- recommending suitable diagnostic centres
- verifying scan requirements
- verifying machine suitability
- verifying contrast requirements
- estimating accurate pricing
- coordinating appointments
- reducing booking errors
- improving patient safety
Providing these documents does not create a doctor-patient relationship with Health Point IND and does not constitute medical advice.
5.3 Prescription and Referral Considerations
- Certain specialised investigations may require prescriptions, referral notes, previous reports, or clinical information depending on diagnostic centre policies, scan requirements, insurance requirements, clinical protocols, or professional guidelines.
- You are responsible for obtaining such prescriptions before booking if required by applicable medical regulations, insurance, or partner facility policies
- You should have the prescription available to present at the Partner Diagnostic Center at the time of the appointment
- Health Point IND does not provide medical prescriptions. Please consult your doctor if you need a referral.
- Attempting to book without a required prescription may result in appointment cancellation at the Partner facility
5.4 Pre-Test Preparation
- You must follow pre-test instructions provided by Health Point IND and Partner Diagnostic Centers (fasting, medication adjustments, contrast ingestion timing, etc.)
- Non-compliance with pre-test instructions may result in test cancellation or rescheduling without refund
- You are responsible for understanding and following all preparation guidelines provided to you
- Contact the Partner Diagnostic Center directly if you have questions about preparation instructions
5.5 Timely Appointment Arrival
- You must arrive at the Partner Diagnostic Center at least 15 minutes before your scheduled appointment time
- If you are more than 30 minutes late, the Partner facility may cancel your appointment and charge a no-show fee
- Health Point IND is not responsible for no-show fees charged by Partner Diagnostic Centers
5.6 No Prohibited Use
You agree NOT to:
- Use our Service for illegal purposes or in violation of applicable laws
- Fraudulently book appointments for yourself or others
- Provide false medical information intentionally
- Harass or abuse staff members of Health Point IND or Partner Diagnostic Centers
- Attempt to hack, breach, or compromise our website security
- Engage in automated scraping or data collection without permission
- Violate intellectual property rights or copyrights
- Upload malicious files, viruses, or harmful content
6. Booking Process
6.1 Availability and Confirmation
- All bookings are subject to availability at the selected Partner Diagnostic Center
- Slot availability displayed on our Platform is real-time but not guaranteed until payment is processed and confirmed
- You will receive a booking confirmation email or SMS as soon as reasonably possible after successful payment
- If a slot is no longer available after payment, we will offer alternative slots or provide a full refund
6.2 Pricing and Cost Breakdown
- All prices are in Indian Rupees (INR) unless otherwise stated
- Prices displayed on our Platform are subject to change without notice
- The price you see at checkout is the binding price for that booking
- All taxes, GST, and convenience fees are included in the displayed price
- No hidden charges will be added after payment
6.3 Pricing Variability Disclaimer
IMPORTANT: Pricing may vary based on:
Prices displayed by Health Point IND are based on information received from partner diagnostic centres and may vary depending on machine type, scan protocol, contrast requirements, reporting requirements, urgency, and centre-specific policies.
- Test Complexity: More complex scans (e.g., full body MRI with contrast vs. single-area CT) cost more
- Scan Area: Different body parts have different pricing (head MRI ≠ whole spine MRI)
- Urgent/Priority Slots: Premium slots with shorter wait times cost more
- Add-on Services: Post-processing, 3D reconstruction, or specialist reports incur additional fees
- Insurance and Discounts: If you have insurance or are eligible for discounts, pricing is adjusted accordingly
- Partner Center Rates: Different diagnostic centers have different pricing for the same test
You understand and accept that the final price is determined by the selected Partner Diagnostic Center and is displayed before you confirm payment.
6.4 Instant Bookings vs. Quoted Bookings
- Instant Bookings: Pre-approved slots with immediate confirmation after payment
- Quoted Bookings: Custom bookings requiring Partner facility approval. You will receive confirmation via email/SMS after the Partner facility approves the request
- If a quoted booking is delayed, we will notify you and provide cancellation or refund options as appropriate
6.5 Machine Compatibility
- Some Partner Diagnostic Centers may not have machines suitable for your specific needs (e.g., weight restrictions, claustrophobia concerns, etc.)
- You should disclose any relevant constraints during booking, and we will recommend suitable centers
- If a Partner facility cannot accommodate you on the day of the test, you may reschedule or request a refund
6.6 WhatsApp, Phone and Communication Consent
By contacting Health Point IND through WhatsApp, telephone, email, website forms, social media platforms, or other communication channels, you consent to receive booking-related communications, appointment updates, service notifications, and customer support responses.
7. Payment and Refund Policy
7.1 Secure Payment Processing
- All payments are processed through PCI-DSS compliant payment gateways (Razorpay, PayU, etc.)
- Your payment information is encrypted and secured
- Health Point IND does not store complete card details (we use tokenized payments)
- Payment transactions are subject to payment gateway terms and conditions
7.2 Cancellation and Refund Policy

Exceptions and Special Cases:
- Medical Emergency: If a genuine medical emergency prevents your attendance, contact us immediately with documentation. Refunds will be considered case-by-case.
- Partner Facility Cancellation: If the Partner Diagnostic Center cancels your appointment, you receive 100% refund or priority rescheduling.
- Slot Unavailability: If your booked slot becomes unavailable after payment, we offer alternative slots or 100% refund.
7.3 Rescheduling
- You can reschedule your appointment more than 48 hours before the scheduled time, with no fee
- Rescheduling within 24-48 hours incurs a ₹250 convenience fee
- Rescheduling within 24 hours may not be possible depending on availability

7.4 Failed Payments
- If your payment fails, you will not be charged and no booking will be created
- If you were charged twice due to a payment gateway error, contact us within 48 hours with transaction details for a refund
- We cannot process refunds for payment gateway disputes—you must contact your bank or payment provider
8. Partner Diagnostic Center Responsibilities
8.1 Independent Service Providers
- Partner Diagnostic Centers are independent healthcare service providers, NOT employees or agents of Health Point IND
- We do not control the medical services, equipment, personnel, or quality of care provided by Partner facilities
- Each Partner facility maintains their own medical staff, equipment, hygiene standards, and clinical protocols
- Health Point IND is not responsible for their actions, omissions, or any medical outcomes
8.2 Report Accuracy and Timeliness
- Health Point IND is NOT responsible for:
- Accuracy or completeness of diagnostic reports
- Delays in report generation or delivery
- Errors in image interpretation or clinical correlation
- Missing or corrupted digital images (DICOM files)
- Technical issues with report portals or digital delivery
- For report issues, complaints, or corrections, you must contact the Partner Diagnostic Center directly
- Estimated report turnaround times are provided as guidelines only and are not guaranteed
8.3 Report Turnaround Variability
Report generation times vary based on:
- Type of test (simple X-ray: 2-4 hours vs. complex MRI: 24-48 hours)
- Radiologist availability and workload
- Need for specialist review or second opinion
- Technical issues or re-scanning requirements
- Holidays, weekends, or after-hours appointments
Estimated turnaround provided at booking is an estimate only. Delays beyond 48 hours should be reported to the Partner facility directly.
8.4 Machine Availability and Scan Protocols
- Machines may be unavailable due to maintenance, calibration, or breakdown
- If your booked machine is unavailable, the Partner facility will offer an alternative or reschedule your appointment
- Scanning protocols may vary between different machines and facilities
- Some facilities may use different imaging parameters or reconstruction methods that may affect image quality or interpretation
- You understand and accept these variations as normal in clinical practice
9. Emergency Situations
IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY
Health Point IND is NOT an emergency medical service. If you are experiencing severe symptoms, chest pain, difficulty breathing, severe bleeding, signs of stroke, or other life-threatening conditions:
- CALL 911 or your local emergency number immediately
- Call 108 (National Toll-Free Ambulance Service in India)
- Visit the nearest hospital emergency room
- DO NOT wait for a diagnostic test appointment
Health Point IND is an appointment booking platform for non-urgent diagnostic tests. We cannot and do not provide emergency medical services or transport.
Health Point IND will not be responsible for any adverse outcomes resulting from delays in seeking emergency care.
10. Limitation of Liability
10.1 Our Limited Liability
TO THE FULLEST EXTENT PERMITTED BY INDIAN LAW, HEALTH POINT IND SHALL NOT BE LIABLE FOR:
- Any direct, indirect, incidental, special, consequential, punitive, or exemplary damages
- Loss of profits, revenue, data, or business opportunities
- Damage to personal property or medical equipment
- Bodily injury, illness, or adverse medical outcomes resulting from diagnostic tests
- Emotional distress, humiliation, or reputational harm
- Any damages arising from decisions made based on diagnostic reports or Health Point IND information
THIS LIMITATION APPLIES EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
10.2 Maximum Liability Cap
In any case where we are found liable for any claim arising from our Service, our total liability shall not exceed the total amount you paid for the booking that caused the claim.
10.3 No Warranty of Diagnostic Accuracy
DISCLAIMER: Health Point IND provides NO WARRANTY regarding:
- Accuracy of diagnostic test results (this is the responsibility of Partner Diagnostic Centers and radiologists)
- Availability of equipment or appointment slots (dependent on Partner facilities)
- Timeliness of report delivery
- Suitability of recommended tests for your medical condition (this should be determined by your physician)
Reports provided by Partner Diagnostic Centers are their professional opinion only and do not substitute medical consultation with qualified physicians.
10.4 No Professional Medical Advice
Any information, articles, blog posts, or guidance provided on our Platform is INFORMATIONAL ONLY and NOT professional medical advice. Do not rely on our Platform for medical diagnosis or treatment decisions. Always consult a qualified physician for medical advice.
10.5 Reviews, Testimonials, and Ratings
Reviews, testimonials, and ratings displayed on our Platform are provided for informational purposes only. We may publish user-submitted feedback with consent, but we do not independently verify the accuracy of third-party reviews or testimonials. They do not constitute medical advice or guarantee service quality.
11. No Guarantee of Results or Medical Outcomes
- Health Point IND does NOT guarantee that diagnostic tests will detect diseases or abnormalities
- Some diseases may not be visible on imaging or lab tests (false negatives are possible)
- Test results are subject to radiologist/pathologist interpretation and individual variation
- We do not guarantee that receiving a diagnostic report will change your treatment or prognosis
- Medical outcomes depend on many factors beyond diagnostic tests (treatment choice, patient compliance, disease progression, etc.)
- You accept that negative test results do not conclusively rule out disease. Always follow up with your physician for clinical correlation.
12. Intellectual Property Rights
- All content on www.healthpointind.com (text, images, logos, design, code) is owned by or licensed to Health Point IND
- You may view and download content for personal, non-commercial use only
- You may NOT reproduce, distribute, modify, or sell our content without written permission
- DICOM images and reports provided by Partner Diagnostic Centers remain their property and are for your personal medical use only
- Do not upload or share reports publicly without the Provider's consent
13. Termination of Service
- Health Point IND reserves the right to suspend or terminate your account if you violate these Terms
- Violations include: fraudulent bookings, false medical information, abusive behavior, or illegal activity
- You may close your account at any time by emailing info@healthpointind.com
- Upon account closure, your data will be retained for legal compliance (as detailed in Privacy Policy) but not used for further communication (unless required by law)
14. Governing Law and Dispute Resolution
14.1 Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of India, specifically the state of Maharashtra, without regard to its conflict of law principles.
14.2 Jurisdiction
Both you and Health Point IND agree to submit to the exclusive jurisdiction of courts located in Pune, Maharashtra, India.
14.3 Dispute Resolution Process
Before filing a legal claim, you agree to:
- Contact us: Email info@healthpointind.com with a detailed complaint
- Provide evidence: Include booking references, receipts, correspondence, and specific grievances
- Allow resolution time: We will respond promptly with a resolution or explanation
- Negotiate in good faith: We will attempt to resolve the dispute amicably before legal action
- Escalation: If unresolved, disputes may be escalated to Consumer Protection Authority or courts as appropriate
14.4 Consumer Protection
You may also file complaints with the District Consumer Protection Authority or the National Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019, if you believe your consumer rights have been violated.
15. Miscellaneous
15.1 Entire Agreement
These Terms and Conditions, together with the Privacy Policy and any other policies referenced, constitute the entire agreement between you and Health Point IND regarding your use of our Service. Any prior agreements or understandings are superseded.
15.2 Severable Clauses
If any provision of these Terms is found invalid or unenforceable by a court, that provision shall be removed, and the remaining provisions shall continue in full force and effect.
15.3 Waiver
Failure to enforce any term of these Terms does not constitute a waiver of that term or any other term. Any waiver must be in writing and signed by both parties.
15.4 Third-Party Rights
These Terms are between you and Health Point IND only. No third party has the right to enforce any provision unless explicitly stated.
15.5 Changes to Terms
We may update these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of the Service constitutes acceptance of updated Terms. We recommend reviewing these Terms periodically.
